Summary: Active and passive right to information is based on the UN
Universal Declaration on Human Rights (1949). It anticipates
contents of a number of traditional branches of law, e.g.
civil, penal, international, and the similar, which are fully
developed, but which only partially meet the needs of
informatics and information. Therefore it is necessary to
define the constitutional basis for the new branch of law -
information law.

Summary: The basis for creation of information law are the freedom
of
information and the right to information. Freedom of
information, derived from the freedom of thought, freedom to
express thoughts, and freedom of press, turns an information
into a commodity sui generis, with its specific market. The
right to information is achieved through public information,
private information, and the like. If all the information
sources fail, the state is obliged to provide the necessary
information to its citizens.

regulate the relations in the areas of information,
informatics, and communication. It defines the position of a
person as a subject within these technologically,
organizationally, and economically very complex systems, as
well as his or her rights and obligations. Responsibilities

Summary: Ombudsman is a new institution introduced in Croatia by the
1990 Constitution. The basic idea of this institution, both
abroad and in Croatia, is protection of citizens' rights from
harm by administration. Breach of the freedom of and right to
information is quite often and possible. Therefore it is
suggested that within the institution of ombudsman, there
should be an ombudsman for the protection of freedom of press,
but also for the protection of these citizen's rights from the
administration and from the mass media.

Summary: Administration develops its information system according to
a
law. It is used for the administration's needs, but also to
meet the rights of citizens to information. Administration
information system functions as a subsystem of state
information system, providing information to citizens. This is
the passive right of a citizen. It is constitutionally
defined, and represents a practical right which a citizen
achieves with the help of an administration, especially if
other subjects of information fail.

Summary: Relations between state administration and local
selfmanagement can be defined in various ways. Same
administration offices can serve both the needs of a state and
a local selfmanagement unit. Introduction of informatised
administration, which should primarily fulfil the rights of
citizens, can improve the quality of administration's
services. Use of informatics means at the same time enables
both decentralization and centralization, depending on the
particular needs.

Summary: Im Reichtssystem der Republik Kroatien wie auch in den
Reichssytem aller modernen Staaten, tritt die Antinomie auf zwischen den
konstitutionalen Prinzipien der Freiheit zur Auserung der eingenen Meinung
und des Reichts auf Ehre und Wurde. Deise Antinomie kommt auch im
Strafrecht Kroatiens zum Ausdruck, im dem zum Schutz der Ehre und Wurde die
Straftaten aus dem Kapitel IX Strafgesetzes der Republik Kroatien deinen
wahrend der Schutz der freinen Meinengsauserung durch die Ornungen uber
Nichtbestrafung fur Verleumdung (Art.75,Abs.4 des STGK) und
uberNichtbestrafung fur Straftaten gegen Ehre und Wurde (Art. 79 des STGK)
garantiert wirt. Aus der Perspektive dieser Ornungen soll also fesgestellt

Summary: Information is becoming an important market commodity. As a
commodity it has collectors, processors, producers, and a
selling system. Commercial and legal features make it a
specific commodity which is related to principles of
truthfulness, punctuality and completeness. The principle of

Summary: The public sector in contemporary states takes over from it

Summary: The intensive development of information and informatics
has neglected the significant part of any system - normative part.
Within the system theory, this normative part is an important factor of
efficient goal achievement. There fore, in this paper theoretical
foundations of norm developmenz in all public systems, even in the field od
information, are discussed. Legal systems, especially in particular
branches of law, require regulating the legal foundations of systems
functioning. This relates also to the information flow within the legal
system because information represents input and output factors of system
which need to define the legal position of the subjects of legal
information process. Because an information system is sensitive to the
rights of subjects, it requires a number of subjective right to be defined.
A mechanism for information flow between users and the legal means for
achieving the unity of a system (especially the standards) also need to be
defined. The responsibillity of subjects in the state information system
has be defined too.
This theoretical framework requires a number of specialized legal acts to
be enacted. In adition, a general law regulating the state information
system is needed. It should serve as a bases for regulating relations in
information and informatics for a longer period of time.

within constitutional systems are identified, and suggestions

Summary: Some methods of information acquisition are not easily
explained by the models that emphasize active information seeking.
Information encountering is indirectly recognized in the browsing and
environmental scanning literatures but has been specifically explored as a
method of information acquisition. This study posed two research questions:
(1) What are the characteristics of information encountering; (2) How does
information encountering relate to users' information behavior. The study
used exporatory research design and qualitative data collection and
analvsis methods. The findings suggested that information encountering is
an integral elemant of information behavior that a multi-demensional way
involves different types of users'information needs. The study contributed
to better understading of the actual practice of users' information
acquisition behavior, and has potential practical implications for both
information users' education and information system design.
