Summary: The introduction reviews the current situation in Croatian
positive penal legislation, and the activities related to the drawing of
the new penal code of the Republic of Croatia.
The most important proposed changes in the general and special section of
penal legislation are listed and briefly explained.
The changes in the general section would involve the following: 1)
consistent implementation of the principle of guilt (no one shall be
punished or be amenable to other penal sanctions unless found guilty of the
commited act); 2) omission of the categoriy of "substantially reduced
mental capacity", and, in principle, an expansion of the list of
bio-psychological grounds for excluding mental capacity; 3) the abandonment
of the concept of "social menace" or "slight social menace"; 4)
redefinition of the institution of extreme necessity in terms of acceptance
of the so-called differentiating theory; 5) changes in the sphere of
sanctions; 6) the introduction of possible substitution of prison
sentences; 7) omission of stricter punishment of recidivists; 8)
reintroduction of the institution of penal action at the motion of the
injured party; 9) introduction and consistent implementation of the right
of the convicted person to rehabilitation as one of the postulates of
current understanding of penal corection.
The special section discusses a number of general, strustural as well as
special changes related to specific felonies or groups of felonies. Changes
also refer to the determination of the amount of fines, the penalties for
specific incriminations, and some new felonies in the incriminations
catalogue.
Finally, the problems related to the drawing up of the new penal code are
reviewed in their overall scope along with the significance of the
historical dimensions as related to modern penal law.

Summary: The author's startin premisse is defined as restriction of
the legislative interventions. It has been formulated this way: the
positive law must be reshaped rationally and cautiously, only when this is
necessary for adopting the constitutional values and for increasing it's
normative value. Some other premisses are discussed as well: realization of
the principle of the rule of law and restriction of the criminal law's
coercivity. Further, there is a basic axiom by which there is no punishment
without guilt and the principle of legality. Then come the principle of
individualisation, justice and victims protection.

Summary: Within revision of the penal legislature one of the central
questions is the system of sanctions of the penal code. Since the
relationship of the state towareds individuals (protectiondegree of human
freedom and rights as well as the level of political, cultural and
generally civilization development of society), is expressed throught
sanctions as means of the state's force, changes being proposed within this
segment of Penal Law are of extraordinary significance. This paper
represents an analysis and critical review about the changes propossed in
the draft of the new Croatian Penal Code, relating to individual sanctioons
of the penal law.

Summary: In the first part of his article, the autor discusses some
issues concerning the special part of the penal code. They are: 1) A choice
a proper incriminations; 2) An appropriate assessment of the offence's
gravity; 3) Logical systematisation of the special part; 4) Conformity
between the special and general part of the code; 5) Quality of technical
editing of normative texts.
In the second part of his article the autor discusses possible
incriminations within the proposed chapters of the special part of the Code
and suggests that particular offences be re-examined, in accordance with
tendencies in the contemporary comparative law.
