Summary: As characteristics of penal law of Golden Bulla the
authoress presents the facts that on the list of delicts there are even
those which hardly contain elements of crime, but for which strict
penalties are defined, and for triple recidivism there is an exemplary
punishment and that is confiscation of property and "disgraceful" expulsion
from the city which presents the regulation aiming to protect the
reputation of the market. She also emphesizes the fact, that except
mentioned expulsion and "taking revenge" for murder, all other punishments
are fines (the first corporal punishment is mentioned only in the text of
Golden Bulla in 1266). A due attention is paid to the regulation of legal
proceedings. Forum delicti commisii of the City court is defined for all
delicts done within the city territory and material competence includes ius
gladii as well.

Summary: Norms of the rules of the inheritance of the Golden Bulla
of Zagreb's Gradec leave some testamentary freedom to the testator of real
estate, but this freedom is very limited. "Consultation" of the civil
council is an unvoidable instance, except if the testator ipso facto is
inherited by his descendants and a wife and if there are not any
successors. By way of legat pro anima, and later by legat for uncognates
due to different reasons (pro gratitudine, pro serviciis), as well as by
the institution of testamentary adoption as an alternative institution of
will, this freedom was greatly widened in the stated centuries.

Summary: In the context of the historical presentation of the
history of the National Parliament of Croatia done by five authors J.
Kolanović, N. Stančić, Ž. Sabol, H. Sirotković and L. Dobronić, the author
in the first part offers the synthesis of creation and of the ZAVNOH
organization, that is the National Parliament of Croatia by emphasizing
historical continuity of both Croatian legislative body and representatives
of the state sovereignty of Croatia (1944-1947). In the second part the
author states the organizational development of the National Parliament of
Croatia in Socialist period from the first Constitution of the National
Republic of Croatia in 1947 until the first post-war multi-party elections
in Croatia in May 1990. In the third part the author describes the

Summary: Constitutional and legal character of the Kingdom of
Croatia and Slavonia 1848-1918 is a topic frame of this paper. The author
wants to show that the constitutional and legal position of the Ban
(Governor) reflected the influence of the Hungarian government and court
while the Croatian parliament represented a limited legislative body within

Summary: In this work the author studies the historical development
of Hreljin directly and when it is not possible, indirectly through the
events in nearly Vinodol and The Croatian Coast. The major point is the
period of antique, early medieval time, forming of Vinodol as particular
territorial entity and the beggining of government of princes of Krk,
especially passing of the Vinodol Code, structure of inhabitants,
organisation of government. This work also concerns the question of
"urbars" of Hreljin and villans obligations to the landlord. At the end the
author gives a brief revue of Hreljin's belonging to different territorial
units until the middle of XIX century.

Summary: The Statute of 1530 for the City of Rijeka, besides
abounding with regulations on the organization of the city, civil and
criminal law, contains as well a certain number of laws relating to Church.
The Church and clergy are exempted from the jurisdiction of the municipal
administrative authorities of Rijeka, which gives them a special position.
It is interesting to compare the solutions of the Statute of the City of
Rijeka with other statutes, especially with neighboring region of Vinodol,
in which clerics were not treated essentially different from the other
population. In the kindred regulations one can see the possibility of
exploatation of the special position, even for illicit purposes. Besides,
the Statute contains some legal institutions that may be connected with the
field of religion and Church.

Summary: In his study on scientific legal contributions of the
academic Baltazar Bogišić the author extensively deals with redaction of
Montenegro Opšti imovinski zakonik za Knjaževinu Crnu Goru (General
Property Code for the Montenegrin Principality) anounced in Cetinje in 1888
and analyzes the fundamental features of the Code. The author concludes
that this scientific legislative enterprise gained Bogišić the title of
European scientist.

Summary: Despite the explicit statement that status cathegories of
predialists and emphyteuts differ, a great deal, they are, however,
equalized in some regulations of the Statute of Zagreb's Kaptol. By using
legal history instruments, the authoress analyzes the sources which, among
other data, contain the ones about legal nature of these status groups.
According to her interpretation, predialist and emphyteuta, are placed on
the opposite sides of medieval social stratification, and these regulations
of the Statute are the result of striving to attract long-term lessees for
unameliorated land of Kaptol.

Summary: The roman province of Dalmatia was established at the
beginning of the Principate and developed fully when Roman law reached its
highest point in respect to classical jurisprudence. Little is known about
jurisprudence in provinces. Records from the rich epigraphic heritage of
Roman Dalmatia, as well as some legal sources, imply the existence of
juristic activity in Dalmatia during the Principate. The authoress finds
that four famous jurists (Pegasus, Javolenus, Africanus, Modestinus) were
engaged in practice of law in Dalmatia. It may be concluded that the law in
this province was formed during the Principate and influenced by the
jurisprudence of Rome.

Summary: In this work the author deals with the theme of
brotherhoods during the Middle Ages with a specific retrospection on the
area of Rijeka. Brotherhoods are firstly religious Catholic orders that
bring belivers together for the purpose of promoting the cult of some
particular Christian saint, sacred rites or virtues. The first part of the
work deals with the brotherhoods in accordance with basic activities
(religious, secular, spiritual in the domain of art, miscellaneous and
superbrotherhoods), thereupon the internal organization of the brotherhoods
and their officials (gastalds, judges, sacristans, notaries, prioress,
protector-donator, fraternity chaplain), and the membership in general.
This is followed by a section referring to the statutes and the economic
power of the brotherhoods. The third part of the work quotes the
brotherhoods that were active in the area of the city of Rijeka from the
Middle Ages to the 20th century, especially their extinguishing through
administrative measures in the course of the 18th century. The work mainly
underlines the neglected aspect of activities outside of the scope of
religion, namely dealing with social problems (for instance, care for the
sick, old and poor members, the burials of the dead, etc.) which may be
compared to contemporary unions, political associations and government
services that have taken over these functions.

Summary: In the introductory part the authoress presents the
development of Šibenik from 8ct to 16ct by observing it through the prism
of the struggle for the communal authonomy. In the second and third part
the authoress states both the date of the creation of the Statute and
description of the Statute as the source of entire law of the community as
well as basic features of its criminal law. The fourth, central, part of
the study represents detailed analysis of the system of punishment. The
authoress offers legal-historical review, statutary regulation and its
application in the political and legal life of the community for each form
of punishment - death penalty, corporal punishment, expulsion, fine,
confiscation of property and imprisonment. In the end she concludes that
prevalance of fine with its public-legal character attributes the fiscal
character to the whole system of punishment of the medieval community of
Šibenik.

Title: Greek-Roman Rhetoric and the Development of Legal Evidence

Summary: In this study the authoress presents a review of the
historical development of Greek-Roman rhetoric, with the emphasis on her
teachings about legal argumentation, influences of which extend - through
the Middle Ages - to the philosophical, namely, legal-philosophical thought
of modern times (school of so called new rhetoric). As a framework she uses
the most representative rhetorical works, of famous authorities, first from
Greek or Hellenistic epoche (Plato, Aristotle, Hermagoras and others), then
those from Roman period (Cicero, Quintilian, so called rhetores minores and
others), and in short, from the Medieval epoche (Cassiodorus, Isidore of
Seville and others). In the conclusion of her study she offers a scheme of
the system of antique rhetoric, also with the emphasis on the logical
reasoning, that is on argumentation.

Title: The Institution of Lawyer's Profession in the Towns of

Summary: In the introduction the institution of lawyer's profession
in the Ancient and Roman period is presented. It is stated that the
institution of lawyer's profession came into being very early in the
statutes of Dalmatian towns. Although it somewhas differs from the
institution of modern lawyer's profession, its basic function from the
early Middle Ages to modern times has kept its frequency in continuity.

Title: What was Tocqueville Looking for in America

Summary: Comprising everything Tocqueville wrote and did as an
efficient politician, we can come to the following conclusion: Tocqueville
is Burke of the middle od 19th century; he finds the fundamental virtues of
the American democracy in its conservative principles. His "American
Democracy" is not a keen socio literary study but scientific work of the
political theory. Tocqueville became significant for America only in the
second half of the 20th century due to the growing democracy and social
equity, therefore he became the starting point for the
"new-conservativism". He is the founder of the democratic conservativism.

Title: From the Legal Past of Zagreb

Summary: In the study the authoress analyzes property rights of
Zagreb's Gradec (according to the sources dating from 14th, 15th and early
16th century) as well as numerous "accompanying" institutions. By using
previous researches on the functioning of administration and judiciary, on
the extent of the reception of Roman law to the customery law and so on,
she tried to reconstruct the law of the inheritance, status cathegories of
population, property-rights position of woman etc. Some institutions under
the jurisdiciton of Zagreb bishopric and Kaptol as well as Turopolje
(campus zagrabiensis) are discussed, namely concept of emphyteusis
according to Kaptol Statute, institution of "quarta puelaris" of the
Turopolje law and so on.

Title: The Principle of paterna paternis - materna maternis in
the Practice of Zagreb's Gradec (15th ct.)

Summary: The authoress studies the sources in which the above stated
principle had been mentioned in a few variants. Its "classical" variant is
present (only in one source) but there is another one, according to which
the city magistrate decides that property, if conditions for the
application of this principle are fulfilled, is set aside for "ad matrem et
uxorem" of the testator, and still other "medium" variant according to
which the testator himself leaves the property to his widow, but only
"usque ad vitam", and after her death it is "pro anima sua". However, the
testamentary disposal in favour of the wife prevails in practice therefore
application of this principle may look "unfamiliar".

Title: Notars of Zagreb's Gradec

Summary: In the time when medieval West-European notaryship passed
its flourishing phase, notars - in their classical function - appeared only
exceptionally and rarely in Zagreb's jurisdictions. In the period from the
middle 12th ct to early 16th ct notars were only "secondary followers" of
credible places (loca credibilia) of the medieval Slavonia. Notarius
civitatis in Zagreb's Gradec had the authorities, functions and
significance which strongly separated him from the functions of public
notar. The subject of this research are sources that contain data about
notars in Zagreb's Gradec at the period indicated.

Summary: This work can be placed between demanding philosophical
systems of the natural law and literature designed for students. The
successor of Grotius, Hobes, Pufendorf and Thomasius, Johann Gotlieb
Heinnecius succeeded with this work to establish studying natural law at
most Universities in Europe during 18th ct having adapted studying of so
called "sociabilitas" to the level of academic studying. Reprint of the
first edition (Halle, 1737) with the parallel translation of the latin
original into German (P. Mortzfeld) was commented by K. Bergfeld, the
associate of the Institute for European legal history in Frankfurt upon
Maine.
