Summary: In Croatia, the Law from 1934 is still effective, which
prescribes that all hospitals are obliged o inform the court of
jurisdiction about any non-voluntary hospitalization of mental patients.
Upon the received information and according to their responsibilities, the
courts start with their proceedings (direct contacts with the patient,
insight into the medical documentation, forensic evaluation) and come up
with the decision either to detain or to discharge the non-voluntary
hospitalized persons. In practice, however, this Law is violated because
some
psychiatrists are not informed about it and others violate it deliberately
considering the non-voluntary hospitalization as an exclusive medical issue
which should be solved within the
medical profession itself. From the point of view of protection of basic
human rights of mental patients, especially the right to freedom, as well
as the general legal security, the present situation is of utmost
dissatisfaction. Therefore, this paper analyzes how it came to such an
unacceptable situation in practice, but also how and why it should be
changed.
