    Summary: We have analyzed application of process law norms created inorder to eliminate from the penal procedure such juveniles forwhom there exist no basis for penal procedure, or criminalcharges as well as the influence of certain factors on the choiceof penal sanctions. Regarding the theritory and the type of thecriminal acts the decisions of public prosecutors have beenanalysed, with the particular emphasize on the decisions ofpublic prosecutors and the council for juveniles in the relationof criminal behaviour and the type of sanctions. For less than50% of juveniles, public prosecutors propose to the council forjuveniles some sanctions such as educational measure. Theintensity of selection is almost equal to the one made after thepreparation procedure is completed. Comparison of the selectionintensity in different districts showed that there existsignificant differences, which are not based on the structure andcriminal intensity. The results of investigation of selectivemechanisms in the penal procedure showed that it is necessary todiscuss the way and the extent of penal sanctions toward juveniledelinquent. The relations between the type of the crime and thetype of sanctions show that the severity of crime influences in agreat extent the court verdict whether to apply institutional ornoninstitutional sanctions. If further investigations will showthat more severe delicts, especially those with violent modalityshow higher correlations with the lower educational prognosess,than the observed connection between the abstract severity of thecrime on the one side and the type of the sanction on the otherside could be positively marked.

    Summary: Traffic delict is a negative social event, which has to beeliminated. Prerequistic of the effectiveness of each takenaction is understanding basic elements of this concept. In orderto accomplish this, the concept of traffic delict should beexplained in more details, which wasn't case in earlierinvestigations of traffic accidents. This paper is presenting thestructural analysis of this concept, based on the general andcommon features. Specific and cluster concept as well as theirdefinition, division and application were discussed. Basicconcepts of the traffic delicts are: endangering traffic safety,particular ambient and the traffic system. This represents thebasis for further classification and specialization of theconcept and more detailed analyse of particular types. This couldalso give the opportunity to create specefic morphology in theinvestigation of particular categories of traffic morphology inthe investigation of particular categories of traffic delicti. Atthe same time facts from this investigations can be used in orderfields, primarily in penal law.

    Summary: Property crime as a problem outgrows national frontiers andeconomic, social and cultural development of the society. Basicways of property crimes and the influence on their repelling havebeen analyzed. The thesis that the characteristics of theproperty crime influence the organization and the approach toit's repelleng have been checked on the basis of indicatedindexes (the characteristics of property crime), as well as theneed of the strategical move in the police functioning regardingthe crime control and prevention. Some tipical characteristics ofproperty crime have been separately investigated (such as:participation, oppeness of property crime, anomity of criminal,traces, the influence of time on the success of discoverty of thecriminal, and the criminals themselves). Conclusion of thisspeculation is a that strategical move in the organization, andfunctioning with lead the police and the society in the betterposition, regarding criminals involted in property crimes.

    Summary: The initial hypothesis of this paper was that the delinquentpersonality and it's behaviour can't be explained if taken out ofit's environmental influence. The influence of the demographicand sociological characteristics has been discussed within thecontext of sociological nature of such behaviour, regardless ofthe possible etiological basis which lies in the specificpathological personality constellation. Elements of thesociodemographic characteristics have been discussed in details,as well as some demographic and sociological studies of violentbehaviour. Results of such constellation are: characteristics ofthe system of demographic and sociological traits in personsshowing violating behaviour can be distinguished according to theextent of their connection with violent crime, age, sex, maritalstatus, family status, permanent residence, time period, regionalcharacteristics, physical environment, etc. When demographic andsociological determinants of violent behaviour are studied it isnecessary to analyse socio-economic status, primary micro andmacro social environment, educational level, work socialisation,inclination to alcohol and other. Elements of demographic andsociological structure of violent behaviour are also important;behaviour isn't direct consequence of any of these elements, it'setiological relevance has to be regarded within the complex of"socio factors" and broader, with the necessity of analysing thestructural influence of "bio-psycho" factors.

    Summary: This paper presents a great number of domestic and foreigninvestigation which are discussing the connection betweendifficulties in schooling and juvenile delinquency. Thisinvestigations are stressing out the positive connection betweenschooling success and crime of children and youth. Or in other words obvious behaviour disturbances, more difficult modalitiesand more frequent delinquent activities, will disturb theschooling success of juvenile delinquents. This paper alsopresents some invastigations which are pointing out higher andlower connection between particular family circumstances andschooling difficulties. Particular attention was given to thecharacteristics of theritory, while investigations mostly confirmthesis that the disturbances of schooling in general haveterritorial distribution of crime. This paper presents in detailsbasic results of investigations of juvenile delinquent'sschooling from the four regions in the Republic of Croatia.

    Summary: Following the data at police and public prosecutors disposal, theautors analyse the extent and fluctuation of delinquency amongchildren and minors during the period of ten years. The studyfocuces particularly on "dark number" criminality and examinesthe validity of available figures. Juvenile delinquency is alsoevaluated on the basis of research on "tender age" criminal ratein relation to the total number of children and minors in variousregions of Croatia. The autors present some characteristics ofjuvenile delinquency in different regions with heteroginiusdegree of urbanization and outline criminal juvenile recidivismas well as some phenomenological features of delinquentbehaviour.

    Summary: A modern and efficacious internal revenue service isunthinkable without an appropriate information system based onadequate information equipment. This has been shown by thedevelopment of internal revenue services in the developedcountries of the world. Only through the elaboration of a uniforminformation system at the level of the republic as a whole is itpossible to create an internal revenue service that will be ableto fulfil its tasks. Such an information system would consist oftwo functionally linked subsystems (private individuals and legalentities) and of a subsystem of commune and distict internalrevenue services. At the commune or district level internalrevenue services would keep the bulk of records of data ontaxpayers (data on revenues, profits, incomes, property, taxreliefs and exemptions, dependent family members, etc.) and theirtax obligations. The republication internal revenue service wouldmainly keep syntethic data and of this system should be theregistration numbers of individuals and legal entities. Such aninformation system would be linked with the information system atthe commune level (if such has been established), the informationsystem of the Board of Customs, the information system of theMinistry of Internal Affairs, the information system of theauditing service, which will, when it has been established, alsosupervise legal entites, and other information systems (of funds,etc.). In the transitional period the solution will lie in thecreation of a financial or internal revenue service which willhave broad powers, especially in respect of indirect fiscal obligations (sales tax, customs duties, etc.),

    Summary: The aim of this investigation of changes in canonic relations ofsocioeconomic characteristics and crime among persons of age inCroatia in the period from 1968 to 1986., was to estimate thequality and quantity of connections between latent dimensions ofsocioeconomic development and the most important variables ofcriminal behaviour. The hypothetical frame expected that 1)indicators of the development and the types of criminal behaviourin a particular social environments can be statisticaly expressedas pair of highly and significantly connected canonic variablesand 2) the nature of such relations is not significantly changingin function of time, even in the circumstances of significantsocial changes. Data that were obtained during this period oftime are presented in 19 tables, each consisting pairs of canonicvariables of the development and crime, and their correlationswith attached determination coeficient. This investigationundoubtedly showed that between the social development and crimethere exist significant and high correlation. The connectionbetween key indicators of the socioeconomic development andproperty crime is particualry obvious. Other forms of crime,particualry those consisting of higher personal determination(destructive criminal acts, which base are the aggressivepersonality tendencies) are not explained well enough in choosedcluster of developmental variables. The social determination oftraffic delicti is unclear, because the obtained data only pointout the material side of the problem, or in orther words theconnection of the development and the possibility of individualto obtain a vehicle. Among all types of crime that were analysed,sexual crime is the type of crime that isn't explained wellenough. This is so because in it's formation a great influencebelongs to personality factors. The second reason is the fact thabecause of environmental attitudes and inconsistent penal policy,such crimes are rarely registered and punished. Some suggestionsfor further investigation have also been offered. It has beenfound that the statistical data collection on the municipal levelshould be improved (particualry in cases of indicators of socialand cultural development). In that way more clear picture aboutsocial mechanisms that are increasing the probability ofdelinquent behaviour will be obtained. Authors have alsosuggested that possible further investigation could clear theinteractive influence of macrosocial, microsocial and personalfactors in criminal behaviour's creating.

    Summary: This paper is a survey of the development of expert andscientific cognitions and conceptions of recidivism from thelegal, criminal and penal aspects. Although partly a criminalactivity, this social phenomenon is dealt with separetly becauseof its specific characteristics, especialy its dangerousness fora society and characteristics of its "protagonists". The authoris analysing numerous and rather different understandings andconceptions of this negative social phenomenon that have as aconsequence certain legislative, criminal and political solutionsaimed at its prevention and elimination.     Summary: This article tries to evaluate the constancy of some minorcharacteristics in the Republic of Croatia. The authors analysedthe type of offences and particular socio-demographic andcriminological variables. They expected greater deviations fromthe usual situation since the research was based on the under agepopulation (N=4667) registrated with the Public Prosecutorsduring the critical war year (1991). However, those deviationsdidn't manifest themselves. The participation of girls wasrelatively twice as little as it used to be. But there wasnoticed a higher degree of risk than minors could endanger humanlife and property and commit both offences against public safetyand violent crimes.

    Summary: The structure and rate of violence in Croatia are examined on thebasis of data relating to persons charged with violent actswithin theree (1975-1978) and five (1975-1991) years periods.Taking into account a stage of crime accomplishment, theintensity of criminal activity, and a victim's sex and age, theauthors consider common characteristics of violent crimescommited by minors, and majors. The observed sample comprisesconvicts of: murder, man-slaughter, incitement to suicide,causing physical injures, taking part in a browl, child rape andabuse, sex offence, robbery, assault on an official and violentconduct in prison. Finally, there are also analysed the followingcrime relevant variables: place, time, means, circumstances, theoffender's signs of alcohol intoxication, residence, accomplices,the victim's behaviour and injuries he suffered as well as theprevious offender's sentences.

    Summary: This paper presents the extent, trends and structures of crimescommitted by minors and adults on the teritory of the Republic ofCroatia in 1992. According to the data collected by the NationalInstitute of Statistics, the authors analyse a representativesample of the population being prosecuted for criminal offences.However, they draw attention to the various sources ofinformation on criminal behaviour (in our country and abroad),their reliability and limited validity. The crime trends areclosely examined in the five-year period 1988-1992. withparticular attention to the facts and figures registrated in1991. As to 1992., this study finds out that the number ofreported known and not known young and old criminal offenders ison the important and adrupt increase. Besides, there is perceivedthat the increase intensity fluctuates in various Croatianregions (covered by fourteen District Courts). The authors alsonote relatively high rate of unidentified criminal offenders aswell as continuous growth of their absolute number, which can bea warning for crime detection departments to check up theirpersonnel and the way they are organised. The structure of trendsin crime is considered with regard to violent offences (againstpublic order and property) and breaches of official duties. Evenin those cases there are remarkable oscilations between 1992. and1991. Regarding war and post-war situation in 1992, the findingsare not sufficient to support the hypothesis that there is alarge increase in criminal offences in Croatia nowadays.

    Summary: This paper is based on the presumption that there will besignificant changes in crime structure, types and manner ofcrimes, social and demographic features of offenders and theirrecidivism, although the number of caught and reported juveniledelinquents increased in 1992. This hypothesis is tested by theelaboration of the basis of the CONTAB programme and bycomparison of the results obtained with the identical ones forprevious periods. Among the number of interesting information onjuvenile delinquents in comparison with the former long period,the increase of the proportion of offenders against property andthose who live in urban centres has been observed. On the otherside, the proportion of sexual offenders, as well as theproportion of persons who commit crimes against life and body,and proportions of girls, children and recidivists havedecreased. Those and other changes established in the juveniledelinquenacy structure have been considered in the context ofimportant macro-social changes in the Republic of Croatia,especially tha war and it's consequences.

    Summary: This paper presents descriptive analyses of psychological,sociodemographic, economic, social and cultural features of 30validy sentenced infanticides in Croatia in the period between1985. and 1990. The results of analyzed variables are shown intables and some cases are described. Psychological status ofinfanticides is characterized mainly by average inteligence,cultural deprivation, emotional instability and immaturity,self-centerdness, primitivness, social immaturity, passevness,neurosis and tendency to depression. The analysis of the passivsocial status of the persons suggests deficiency of socialcontact during childhood and youth and strict and patriarchaleducation. Data on actual social circumstances show very lowproffesional, economic and housing status of the observedpersons.

    Summary: This paper reviews certain distinguishing features of juveniledelinquency connected with violence in the Republic of Croatia.The authors analyse the relationships between various violentcrimes and three groups of variables: social and demographicparticularities of adolescent offenders, crime patterns andrecidivism. They examined a sample (n=273) of juveniledelinquents (less than 18 years of age) charged of violentoffences commited in 1991 (according to Public Prosecutors'Offices). The data are considered in the war context conformablyto the CONTAB (Zlobec, Varga, Momirović) programme. The findingsindicate less than a half of examined delinquents committedviolent crimes and robberies, one third of them behaved violentlyand obstructed officials to perform their duty, one fifthcommitted sexual offences, homicides and took part in brawls,street fights etc. The results of the analysis chiefly confirmthe authors' hypotheses. It is obviously that homicideperpertrators and sexual offenders have something in common. Theyusually live in small towns, commit a crime only once and as arule they do not have previous police record. On the contrary,violent crime and robbery offenders are more often urbanadolescents-recidivists known to the police. In the light of thefindings the authors anticipate future juvenile violent crimecharacteristics and propose some countermeasures (i.e. betterpreventive programmes) emphasizing care for adolescents at riskto become offenders.

    Summary: The purpose of this study is to examine certain features ofjuvenile delinquency in Croatia. The autor explains relationsbetween some property offences and three groups of variables: a) socio-demographic characteristics of juvenile offenders; b) models of criminal operations; c) recidivism. On the basis ofthe prosecutorial offeces data (Croatia, 1991.), the analysisfocuses on the sample of 3936 property offenders younger than 18years. The analysis was carried out conformably to CONTABprogramme (Zlobec, Varga, Momirović). Though the author'shypothesis provided mainly justified some particularities can bediscussed: property crime recedivism is more frequent phenomenonthan it is the juvenile delinquency recidivism itself; there is arelatively double rate of serious thefts in respect to larceny;there is a relatively half the number of girl-offenders but theiroffences are socially more dangerous than they used to be. Thesefacts are considered in the context of the present socialsituation and with intention both to invisage the peculiaritiesof future property offences and give some suggestions about theirprevention.

    Summary: The author analyses relations among seven juvenilesociodemographic features and forms of their criminal behaviour,with special emphasis on crimes against property, on two samples(N1=2734, N2=661) of juveniles sanctioned in the Republic ofCroatia in the period between 1990. and 1992. Following the datagiven in contingency tables the author finds only three out ofthe total of 14 pairs of variables: juveniles age and type of themain crime, whether parents are alive or dead and the type of themain crime, juvenile school background and the type of the maincrime. Statistically no significant relations betweensociodemographic features and some crimes against property havebeen found. The author considers these results in the overallethiological and phenomenological mechanism. The author ascribeschanges in the criminal behaviour structure to the dynamic anddialectic complex of many factors, but specially to the actualwar situation and it's numerous and various repercussions.

    Summary: The survey presents an analysis of trends in juvenile delinquencyin Croatia during the periods 1986-1990. and 1984-1988. Theobtained data suggest that four fifths of young offenderscommitted crimes against property. In comparison with the minorsbetween 14-16 years of age, older minors (16-18) are more oftenthe perpetrators of other crimes than property ones. The treatedadolescents, living only with one parent, represent mainly theoffenders against private dignity and morality. Illegal actsagainst public peace and order, against life, bodily harms etc.are committed by young people usually in urban area, namely intheir dwelling spaces. On the other band the socio-economic andtraffic offences are more frequent in rural areas. It is obviousthat the preventive measures should be taken to help childrenbelonging to critical groups in their early age. That means thatspecial attention is to be payed to the way of life andparticulary the spare time of minors living with one parent inrisky areas.

    Summary: This paper gives an analysis of general drift of perpetuators ina 10-year period on the teritory of Croatia in the relation tothe districts and to the regions of local authorities for 14district courts. The teritorial differences were interpretedaccording to the type of crime in general, and especially inregard to the type of delict related to property and life andbody violations. The intensity of delinquent's crimes, the casesof accomplice, and crime recidivism were observed in relation tothe type of criminal activities, the property offence and lifeand body violations. The crime distribution was analysed due tothe extent of urbanization of the place where the crime had beencommited. The place was defined as a residence of district court,a centre of municipal court and, at the same time was not a scatof the court. Also, a number of known perpetuators was in adecline, and with regard to the observed modalities of crimethere existed significant differences relevant for the creationof different strategy in crime prevention.

    Title: The influence of the socio-economic development on the juvenile delinquency in Croatia

    Summary: Under the model of canonic correlation analysis and under themodel of canonic correlation covariance analysis there have beenanalysed the relations between the factor of socioeconomicdevelopment and juvenile delinquent behaviour, on the sample of100 municipalities in Croatia in 1986. The factors of thesocioeconomic development have been collected in a previouscomponent analysis obtained from the statistical investigationprogram. These factors have been identified as 1) the developmentof trade and catering, 2) population density, 3) agriculturaldevelopment, 4) the development of railway traffic, 5) primaryschool development, 6) the development of flat building, 7)health care development, 8) the urbanisation level, 9) industrialdevelopment, 10) the value of basic goods, 11) the development offriut and wine growing and 12) the development of passenger andrailway traffic. Data about the delinquent juvenile behaviourwere obtained from the statistical data about juveniles who werecentenced for committed crime. These data formed furthervariables: 1) delicti against life and body, 2) property delicti,3) other delicti, 4) material damage and 5) prison centences.Very similar results were obtained under both models for dataanalysis. The only significant canonic correlation (.64) and theonly quasicanonic correlation that remained (.56), were theconsequence of the fact that the socio-economic development,particualry the development of the terciar activitiessignificantly influences the rate of criminal acts againstproperty, but has no influence on criminal acts against life andbody.

    Summary: A standardisation of relevant criminal procedure mechanisms inselecting the denounced, the accused or those charged with acrime with a purpose to eliminate them from a criminalproccedings is a significant result of compromise between makingthe criminal trial more effective on one side and not letting aninnocent person to be sentenced on the other side; also , toprevent him from beeing a subject of a criminal procedure. Inthis respect the object of this research was to find out whetherthere was discrepancy between legal standards and criminalproceedings, and, especially, if there were, and to what extent,for the purpose of selection any significant differences in therealisation of legal norms between some parts of territory inCroaita and certain types of crime. Generally we can say that theeffect of selection mechanisms increased not only in the caseswhen the decision to report against someone was to be made butalso at various stages of criminal proceedings. The intensity ofselection has been contiually increasing in the last three yearsof investigation, and especially in 1990. Thus we can say that inspite of certain oscillations in some years and the unevennessbetween some territories and some types of crimes it was noticedthat there was a tendency for a more frequent selection whenmaking up one's mind to bring charge against somebody, in theapplication of Art 8, Paragrapf 2 (taken from the Penal Code), inmaking decisions soon after the judical investigation wascompleted, but also upon the court's decision to file chargesagainst persons in question. Despite the given information theintensity of selection on the part of the court in case of filinga suit showes the need for reexamination of work and criteria setfor public prosecutors, judges bearing a criminal case and ofout-of-trial councils because the results showed that the rulesof the law of criminal procedure, whose aim was to preventungrounded legal trial against the accused, were not sufficientlyused.
