    Summary: The amendment of the Labour Relations Act, which entered intoforce on April 10, 1992, changed all provisions on collectiveagreements contained in the original text of the Labour RelationsAct of 1990. Author warns that the system of compulsoryassociation of employers in the Croatian Chabmer ofEconomy is at variance with the authonomous regulation of labourrelations through collective agreements. He considers that evenamended norms are based on the same concept as derogated ones.Collective agreements stil have in great measure a compulsorycharacter and presume relatively frequent gavernment interferencein their conclusion, content and implementation. He pleads forstatutory solutions which will ensure an autonomous character ofcollective agreements.

    Summary: Proceeding from a comparative survey of views on strikes and theright to strike, the author considers the conceptual andlegal-technical characteristics of the Federal Strike Act, whichbecame effective on April 13, 1991. The basic conceptualdeficiency is that it strives to regulate the question of strikesseparately from the regulation of other issues concerningcollective labour relations. A special problems is in the Act'sdefinition of a strike which, on the one hand, denies thelegality of all unorganized (spontaneous) strikes, and, on theother, gives grounds for the interpretation that even strikesabout legal disputes are allowed. The author drows attention tobroad possibilities for restricting the right to strike,especially in activities of special social concern and in stateadministration, and to abuses that migth occur due to unclear andinsufficiently elaborated legal provisions.

    Summary: The author analyzes Croatia's legal regulation of the right tostrike. He points out that the provision of Constitution of theRepublic of Croatia garanteeing the right to strike does notspecify who is entitled to this right, nor does it define thecontent of this right. He considers that the right to strike isan individual right of workers. The author warns that inregulating the right to strike of those employed in the police,armed forces and public services, the law-maker has taken amarkedly restrictive approach, and wonders whether this approachis in conformity with the constitutional provision. The authorconsiders that workers' right to strike should be ensured thenecessary judical protection. He stresses the importance of thepopularization of the idea of the right to strike as a humanright essential for the realization of a system of politicaldemocracy and market economy.

    Summary: Author explains the genesis and development of the idea ofadopting a new Labour Act in the Republic of Croatia and presentsthe fundamental principles that guided the law-maker in draftingthe Bill. An extensive analysis is made of the most significantchanges which the passage of this Act should introduce in theCroatian system of labour relations. Author emphasizes that theprivatization and formation of voluntary organizations ofemployers are important preconditions for efficient functioningof the new system. In addition, he considers that it is necessaryto make some other institutional changes, especially in respectof judicial protection of labour rights.

In most of them depopulation was rife and theparticipation of the agricultural populations decreased greatly,there was a diversification of non-agrarian activities and urbanpatterns of life spread through rural areas.     Summary: The protection of women in the system of labour and social legislation is becoming more and more important. In the proposals regarding the change of the relevant legislation, considerable innovation in the status of woman are recommended. Some of these changes are aimed at encouraging the increase in birth rate. The birth rate of a country should not be stimulated by only partial legislative solutions but rather by different legal, economic and social measures. Also, in order to fully protect women, it is not enough only to pass the corresponding legal norms. What we need is a change of the societal attitude and of some other factors that may contribute to the improvement of the woman's position.

    Summary: Disputes on the new labour legislation are at the same time disputes on the interpretation of numerous provisions of the Constitution of the Republic of Croatia on labour relations. The author pays particular attention to the problem of limiting the ownership rights and warns that under the strong egalitarian tendencies inhereted from the past system, limitations should not be allowed that would anull the effects of the privatization of companies. He also advocates the ownership right limitation being applied in the West European countries way. The author also draws our attention to the fact that in the disputes on these issues, the employers are the least numerous and the worst organized party. The author belives that the passing of the new labour legislation will be a test to see to what extent the ideas of political democracy and market economy have been accepted in the Croatian society.

    Summary: Decreased employment, high unemployment, increased "black" employment, decreased real wages and other for labour unfavourable trends have a negative impact on retirement and disability insurance, which shows a negative ratio between the number of retired persons and active insurees. There is also an increased trend of insolvency and substantial financial losses. Retirement and disability insurance has a negative impact on the development of labour relations systems because increased contributions do not stimulate new legal employment. Also, invalids have not been properly provided for and employees in atypical labour relation have not been properly insured. There is no real influence of the parties in the labour relation (employers and employees) on the insurance management. Taking into cosideration the linkage and interdependence of these systems, author advocates their deep transformation and adjustment to the conditions of the market economy.

    Summary: The authors advocate the correction of a disturbed balance between public and private elements by introducing civil-law elements into the system of the Croatian labour legislation. They consider these elements vital in ensuring the required level of autonomy of the subjects of labour relations, which is important for the development of the market economy and the establishment of a more just and flexible system of labour relations. In order to combat the prevailing belif in Croatia that it is only public intervention by state which ensures the protection of the employee, an analysis of the basic ideas of labour relations in the German doctrin is made, as well as of some institutions of the German Labour Law, showing how employee protection is realised in the system of privat law approach to labour relations.

    Summary: The article discusses the topic in two parts: general method of study of labour law, and historical review of philosophical teachings about labour. As established in the first part labour law understood as a scientific disciplin is not a set of legal rules but a body of knowledge on positive labour law, on the one hand, and, on social, i.e., nonlegal aspects related primarly to the labour of blue-collar workers. The second part presents a historical review of philosophical teachings about labour found in ancient and Renaissance philosphy, and liberalistic and materialist doctrine (as related to liberal capitalism), the reformist doctrine (as related to large corporation capitalism), and the Nazi-fascist doctrine (as related to German Nazism and Italian fascism).

    Summary: Termination of employment is one of the most controversial issues of the reform of labour legislation. Based on an analysis of the legal and real situation, the authors conclude that the termination of employment, particularly that initiated by the employer, is not o component of the concept whereon the currently valid regulations are based. The theoretical and constitutional basis for termination of employment authors find in new Croatian Constitution, especialy in provisions on freedom of enterprise and the right of ownership. The solutions contained in the Labour Bill, which the Croatian Government has submitted to Parliament, are evaluated on the basis of their comparison whith corresponding solutions in German legislation, judicature and doctrine. The main features are considered of regular and irregular termination of employment, length of notice, forms of dismissal, participation of works counicl and some other relevanat topics.

    Summary: The initiated reform of labour relations in Croatia have been greatly engraved by the war and economic and social troubles caused by it. Author analises numerus provisions of 1990 Croatia's Constitution which offer a good ground for the reform of labour relations. However, in drafting the new Labour Bill significant controversies in theri interpretation have taken places. Obstacles arising from the lack of knowledge on labour relations in market economy are also very important. So far, high level of political and social significance has been attributed to the disputes on the dismissal of the employees who have become redundant, competencies of the decison-making participating bodies to use veto over the employer's decision, and of issues of prolonged effectiveness of the collective agreements being concluded by the compulsory associations of employers.

    Summary: Paper is dealing with the place of the right to strike in the system of fundamental human rights. Special attention is devoted to the relation between freedom and the right to strike and to the definition of the right to strike. The author analyzes the notion and the place that the right to strike has in some important international agreements as are European Social Charter, International Covenant on Economic, Social and Cultural Rights and conventions and oteher documents of International Labour Organisation. Author pleads for a full protection of this right through an optional protocol to the International Covenant on Economic, Social and Cultural Rights (similar to the Optional Protocol to the Internationa Covenant on Civil and Political Rights).

    Summary: The initiated reform of labour relations in Croatia have been greatly engraved by the war and economic and social troubles caused by it. Author analises numerus provisions of 1990 Croatia's Constitution which offer a good ground for the reform of labour relations. However, in drafting the new Labour Bill significant controversies in theri interpretation have taken places. Obstacles arising from the lack of knowledge on labour relations in market economy are also very important. So far, high level of political and social significance has been attributed to the disputes on the dismissal of the employees who have become redundant, competencies of the decison-making participating bodies to use veto over the employer's decision, and of issues of prolonged effectiveness of the collective agreements being concluded by the compulsory associations of employers.

    Summary: In the introductory part of the thesis author gives the definition of labor disputes, types and procedures for labor disputes settlement, role of the arbitration and its historical background. After that, legal status of arbitration establishing distinction between the private and public sector have been explained. Here is very important a distinction between disputes on rights and interests. Disputes on rights involve the interpretation or application of laws, agreements or customary practices, whereas disputes on interests involve the question of what shall be the basic terms and conditions of employment. Disputes on rights are adjudicable under the laws or agreements on which the rights are based and are suitable to settlement by arbitration. Disputes on interests, on the other hand, involve question of policy which, for lack of predetermined standards, have not been generally regarded as suitable for adjudication or arbitration. After that, author describes the arbitral procedure, starting with the arbitrability, the agreement to arbitrate and submission, the arbitration tribunal, kinds of arbitrators and methods of selecting arbitrators, arbitration procedures and techniques, standards for interpreting contract language, the burden of proof and rules of evidence. Finally, the arbitral award and opinion, vacation and enforcement of the award have been studied.
