Summary: The international law and commercial law regulation of the
relationships on the sea and seaboard, the relationships in tourism, seabed
mineral resources exploitation, sea fishing and hunting being included, as
well as protecting, preserving and promoting the marine environment are a
matter of special importance for the Republic of Croatia because,in
addition to its Adriatic Sea oriented official policy, it possesses the
longest coast and almost all of the islands in the east part of the
Adriatic. The legislation of other countries, especially those within the
EEC, the practice of the judiciary (national as well as international),
standards and custom are all of major significiance and have to be studied
to provide grounds for a synthetic approach in creating our own
jurisprudence and legal practice.
Keywords: internationl law of the sea, pacific settlement of international disputes, maritime law, commercial law
Research goals: The main objective of the research is the scientific
cognition of the contemporary International Law of the Sea, contractual and
customary, as well as of the modern Commercial Law and Tourism Law related
to utilization of the resources of the sea (fishing, exploitation of oil
and gas, utilization of sea energy for power supply, etc.) and management
of the tourism on the Adriatic. The results of the research will, of
course, advance our jurisprudence, and, at the same time, will provide
scientific base for normative regulation of the relations on the Adriatic
Sea and its foreshore. We find it especially important to examine the
effects of declaring the economic zone in the Adriatic Sea (delimitation of
the sea among the Adriatic states), rights and duties of the coastal states
as well as the rights and duties of other countries in that zone. The
research is very important for the Republic of Croatia, being that the
largest part of the sea along the eastern Adriatic coast and almost all of
the islands lie within its boundaries. Equally important we consider
studying the legal regulation of fishing and hunting, exploitation of
mineral resources in the sea bed and subsoil, tourism, primarily in the
Adriatic.
